Terms of Use
The agreement between you and the person who makes Dailies. It covers what the app is meant to do, what you can do with the quotes, and (just as important) what a quotes app cannot promise you.
1. This agreement
These terms are a contract between you and Amit Shabtay, an individual trading as a sole trader under the name "Dailies", not a company. Where these terms say "we", "us" or "our", they mean that one person.
| Detail | Value |

You accept these terms by downloading, installing or using the Dailies app, or by using this website. The onboarding screen links you here before you finish setting up. If you do not accept them, please do not use Dailies.
Dailies is offered and available only to users who are 18 years of age or older. By using Dailies you represent and warrant that you are at least 18, that you are of legal age to form a binding contract with us, and that you meet all of the eligibility requirements in these terms. If you do not meet all of these requirements, you must not access or use Dailies.
2. What Dailies is
Dailies is an app for iPhone and iPad that sends you short quotes through the day (a boost, a laugh, a bit of perspective) as notifications, on Home Screen and Lock Screen widgets, and in the app itself. You tell it what you care about and how often you want to hear from it, and it picks from a library that ships inside the app.
That is the whole of it. Dailies is not a social network, a messaging service, a journal, a coaching program or a health product.
3. Dailies is not professional advice
Dailies delivers general inspirational and motivational writing for your interest and enjoyment. It is not medical, psychological, therapeutic, legal, financial or professional advice, and it is not a diagnosis, a treatment or a substitute for care from a qualified professional.
Quotes are selected by an automatic process from a general library. They are not written for your situation, nobody reviews what you are sent, and the app has no way of knowing what is going on in your life. A line that lands well for one person can land badly for another on a hard day.
Do not delay or disregard professional advice because of something a quote said. If you are struggling with your mental health, please speak to a doctor or a qualified professional.
If you are in crisis or thinking about harming yourself, contact your local emergency services or a crisis line straight away. Dailies is not monitored, cannot detect distress, and is not able to help in an emergency.
4. Your license to use the app
Subject to these terms, you get a personal, limited, non-exclusive, non-transferable, revocable license to install and use Dailies on Apple-branded devices that you own or control, for your own private, non-commercial use, as permitted by the App Store's Usage Rules.
You are licensed to use the app, not sold it. We keep ownership of everything in it.
5. The quotes
Where they come from
The library is assembled from three kinds of source: material written, adapted or curated for Dailies; public-domain writing, including texts from Project Gutenberg, the World English Bible, and translations their authors or translators have dedicated to the public domain; and a small set of lines by living authors, used under those authors' own published grants, with attribution and, where the grant asks for it, a link to the original. The license each quote is used under is recorded against that quote rather than assumed for the batch. Where a quote is attributed to a named person, the words are theirs and the attribution is offered for identification.
Attribution is best effort
Quotations circulate widely and are misattributed constantly; this is true of every quote collection in existence, including this one. Attributions are given in good faith and checked as far as is reasonable, but We cannot warrant that every quote is accurately worded or correctly credited. If you spot an error, tell us at help@mydailies.app and we will correct or remove it.
If you hold rights in something you see
If you believe material in Dailies infringes your copyright or another right, write to help@mydailies.app with the exact text, where it appears, what right you hold, and how to contact you. Complaints are dealt with promptly and, where a claim is substantiated, the material is removed in the next release.
What you may do with them
You may read them, keep them, and share individual quote pictures the app makes as described in section 7. You may not extract, scrape, copy or redistribute the library itself, or any substantial part of it, or use it to build or train another product or dataset.
6. Your photos
You can choose a picture from your own photo library to sit behind your quotes. When you do, a copy is placed in the app's private storage on your phone and used only to draw your backgrounds.
It stays yours. It is never uploaded to us, and we claim no rights over it (see the Privacy Policy). By choosing an image you confirm you have the right to use it. Please do not use pictures you do not have permission to use, or images that are unlawful.
8. Fair use of the app
You agree not to:
- copy, modify, translate, reverse engineer, decompile or disassemble the app, or attempt to derive its source code, except where the law expressly permits it despite this restriction;
- extract, scrape or bulk-copy the quote library or any database inside the app;
- rent, lease, lend, sell, sublicense or distribute the app;
- remove or obscure any copyright, trade mark or other notice;
- use the app in a way that breaks the law, or to harass, abuse or harm anyone;
- interfere with the app's security, or attempt to defeat any restriction on paid features.
9. Paid features
Dailies is free to use. A free install follows a set of topics chosen for you from your setup answers, and gets the quotes from those topics, the notifications, the feed and both widgets. Dailies Premium is an optional paid upgrade that opens every topic in the library, lets you follow your Liked quotes and your own My quotes as topics of their own, unlocks the full catalog of backgrounds, typefaces and ambient effects, lets you use your own photos and colors behind your quotes, and removes the wordmark from pictures you export.
- It is an annual, auto-renewing subscription, usually offered with a free trial. The exact price in your currency, the length of any trial and what happens when it ends are all shown on the purchase screen before you confirm. That screen is what you are agreeing to, and it takes precedence over anything summarised here.
- Apple takes the payment, not us. Purchases go through your Apple Account under Apple's terms. We never see your card number or billing details.
- Free trials convert automatically. Unless you cancel at least 24 hours before the trial ends, it becomes a paid subscription and your account is charged.
- Renewal is automatic unless canceled at least 24 hours before the end of the current period. Your account is charged within the 24 hours before the period ends.
- You manage and cancel in Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.
- Restoring: if you reinstall or move to another device signed in to the same Apple Account, use Restore purchases on the Premium screen.
- Refunds are handled by Apple, at reportaproblem.apple.com. We cannot issue them directly. This does not affect your statutory rights as a consumer, including any right to cancel a distance contract.
- Prices can change, and what is included in Premium may change as the app grows. A change will never apply to a period you have already paid for, and where the law requires notice of a renewal at a new price, Apple gives it.
- If your subscription lapses, anything you had set that is Premium-only reverts to a free equivalent. Nothing you created is deleted.
10. Availability and changes to the app
We will try to keep Dailies working well, but this is a small independent app. It is provided on an "as available" basis.
We may add, change, suspend or remove any part of Dailies at any time, at our discretion and without notice. That includes features, screens, settings and the quote library itself: quotes may be added, reworded, recategorised or withdrawn, and a quote you saw once may never appear again. The same applies to backgrounds, typefaces and effects.
No particular feature, quote, background or typeface is promised to remain available, and none of them individually forms part of what you pay for. What a Premium subscription unlocks is the full catalog as it stands from time to time, not a fixed list settled at the moment you subscribed. Where a change would materially reduce what Premium offers, we will give reasonable notice.
Dailies may also be updated, or (with reasonable notice where possible) discontinued altogether.
Notifications are scheduled by iOS on your device. Delivery timing is decided by your phone and can be affected by Focus modes, Low Power Mode, notification settings and the operating system's own scheduling. The widgets ask iOS for a fresh quote about once an hour, and iOS decides when that actually happens. Exact timing cannot be guaranteed.
11. Everything else in the app
The Dailies name, logo, design, screens, code, curated writing and the compilation of the quote library are owned by us or licensed to us, and are protected by copyright and other laws. Nothing in these terms transfers any of that to you.
Background photographs are used under the Unsplash License. Typefaces are used under their respective open font licenses. Those licenses cover their use inside Dailies; they do not give you rights to the app as a whole.
12. Warranties
To the fullest extent the law allows, Dailies and this website are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, or free of harmful components, that notifications will always arrive on time, or that any quote will be accurate, appropriate to your circumstances, or produce any particular result.
If you are a consumer, you have legal rights that cannot be excluded by a contract. Nothing in these terms limits those rights, and where local law gives you a stronger position than this section, that law wins.
13. Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or opportunity, arising out of your use of, or inability to use, Dailies.
Where liability cannot be excluded, our total liability to you for all claims connected with Dailies is limited to the lower of the amount you actually paid for Dailies in the twelve months before the claim, or £50.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
14. Terms that Apple requires
Because Dailies is distributed through the App Store, the following apply:
- This agreement is between you and us only, not with Apple. Apple is not responsible for Dailies or its content.
- We are solely responsible for support and maintenance. Apple has no obligation to provide any support for Dailies. Support requests go to help@mydailies.app.
- If Dailies fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform are our responsibility.
- We are responsible for addressing any claim by you or a third party relating to Dailies or your possession and use of it, including product liability, any failure to comply with legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims that Dailies infringes their intellectual property, we are responsible for the investigation, defense, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and on your acceptance Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
15. Ending this agreement
You can end it at any time by deleting the app. That is the whole process; there is no account to close.
Your license ends automatically if you breach these terms. Sections that by their nature should survive (ownership, warranties, liability, governing law) continue to apply afterwards.
16. Governing law and disputes
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your own country's law, and may bring proceedings there.
If there is a problem, please email us first. Most things are settled faster in a conversation than anywhere else.
17. Changes to these terms
These terms may be updated as the app changes. The date at the top will change, and where a change is significant you will be told in the app or on this site. Continuing to use Dailies after that means you accept the new terms; if you do not, delete the app.
